Special election to be held Aug. 13; four Osage Minerals Estate-related questions will be on special election ballot

During the 14th Special Session, the Second Osage Nation Congress passed a resolution calling for a special election to be held Aug. 13. The special election date follows the recommendation of the ON Election Board, which decided on the Aug. 13 election during its Jan. 18 meeting.

There are six expiring Congressional terms up for grabs, so the June 4 ballot will contain names of those candidates seeking office and will also contain questions on seven proposed Constitutional amendments unrelated to the Minerals Estate.

Congress to meet in Special Session Jan. 20; Election Board suggests Aug. 13 special election date

Four proposed Constitutional amendment questions related to the Osage Minerals Estate are the target of a proposed special election, which could be held in August, pending Congressional approval.

The Second Osage Nation Congress will consider a resolution for a special election during their 14th Special Session scheduled for 9 a.m. on Friday (Jan. 20).

Wind Capital Group seeking $9,241 in legal fees for trial; Hearing set for Jan. 31

An appeal is on the horizon to keep a proposed 94-turbine wind farm out of Osage County, which the Nation argues will harm the Minerals Estate.

Last month a federal judge ruled against the Osage Nation in U.S. District Court, which filed suit through the Minerals Council, to stop the project to be built by Wind Capital Group on approximately 8,500 acres near Burbank.

Both Osage and Wind Capital Group say their stakeholders will lose money if federal judge rules against either side

TULSA, Okla. – There is much at stake in the legal battle between the Osage Nation and wind farm developer Wind Capital Group.

Day one of the wind farm trial wrapped in the U.S. District Court in downtown Tulsa, with testimony coming from both the Osage Nation and Wind Capital. Both testified their stakeholders stand to lose substantial amounts of money regarding the 94-turbine project being challenged by the Nation.

Nation seeks injunction to stop wind farm construction scheduled for November; Wind Capital Group official: ‘Our position has not changed’

Trial dates have been set for Dec. 14 and 15 in the federal court case filed against Wind Capital Group over its proposed 94-turbine wind farm near Burbank, which the Osage Nation argues would harm the Osage Minerals Estate.

The Tulsa federal court dates were set after a judge heard from attorneys representing the Nation and Wind Capital Group on Oct. 26 during an expedited status and scheduling conference. According to the joint motion requesting the conference, construction of the wind farm is scheduled to begin Nov. 19.

Osages settle with the U.S. Gov for mismanagement of their Minerals Estate as an 11-year court battle comes to an end

The Osage Trust Case is over. Osage Nation Principal Chief John Red Eagle, the Second Osage Nation Congress and the Osage Minerals Council have approved the Osage Trust Case Settlement for $380 million.

“This is a pretty historic day . . . and should be a time of happiness, I believe,” said OMC Chairman Galen Crum at the beginning of the special meeting to approve or disapprove the settlement, held at the OMC Chambers Sept. 26.

Osage Nation remains opposed, ‘disappointed’; legal action being considered

The Osage County Board of Adjustment unanimously voted in favor for a Missouri-based wind farm company to build 94 wind turbines in western Osage County near Burbank. Construction on the project could start this fall and would be finished in about one year.

Amid concerns shared by an Osage Nation official and discussion surrounding the communication between St. Louis-based Wind Capital Group and the Nation, the board voted 4-0 to approve a zoning variance for the land originally designated for agricultural use.

Attorney General issues opinion that the OMC is subject to the Open Meetings Act and Open Records Act

The Second Osage Nation Congress posed a question to Attorney General Jeff Jones Jan. 25 that asked whether the Osage Mineral’s Council was subject to the Nation’s Open Meetings Act and the Open Records Act. His reply: yes they are.

His official opinion, issued April 29, said that although the OMC is an independent agency it is still an entity under the Osage Nation and its Constitution.

Yelling and threats from meeting attendees heard on recording of OMC meeting

The Osage Minerals Council voted to rescind a resolution that would have sent $50,000 to the plaintiffs in the Jech vs. United States lawsuit April 20.

The OMC voted to help fund the lawsuit last year but due to some second thoughts by Councilmen Melvin Core and Myron Red Eagle, the check was never sent. Since that time Chief John Red Eagle said he would not support the case or help fund it, members of the Osage Congress brought attention to the account the money was to come from and asked for an audit, and on March 31 the case was dismissed.

Osage Minerals Council opposed bill, saying account that holds income from Kansas property is under OMC control

Osage Congresswoman Shannon Edwards is the subject matter of some angry Osage shareholders lately.

Edwards introduced a bill, ONCA 11-51, during the congressional Hun-Kah session that asked for an audit of the Nation’s S-510 account. She asked that the ON Treasurer audit and segregate the funds in the account.

The OMC sold more than $910,000 in oil and gas lease sales

The Osage Minerals Council had yet another lucrative lease sale, selling more than $910,000 in oil and gas leases Feb. 16.

A crowd of more than 70 attended the OMC’s lease sale, held at the Wah Zha Zhi Cultural Center. The OMC’s previous lease sale, held at the Hyatt Regency in downtown Tulsa for its 10th Annual Osage Oil and Gas Summit Oct. 27, had more attendees but the Feb. 16 sale sold more than $45,460 in leases.

The Osage Minerals Council is looking for talented artists to design this year's Oil & Gas Summit poster

The Osage Minerals Council and the Osage County Producers are sponsoring the annual Osage Oil & Gas Summit this fall at the Hyatt Regency Hotel in downtown Tulsa. The logo and theme this year will focus on the Million Dollar Elm tree that sat on the Osage campus and was the place for oil producers to bid throughout the mid-1900s. The million dollar elm will be the theme for the Summit, and the artwork chosen will be used on posters, brochures, programs, etc.

Jones unanimously confirmed by Osage Congress Jan. 25

The Second Osage Nation Congress unanimously confirmed Jeff Jones as the Nation’s first Attorney General on Jan. 25 during the second day of its Fifth Special Session. Roughly two hours later the Chief’s Office e-mailed a statement that questioned the validity of Jones’s confirmation.

“While the Chief respects that the Congress may read the Constitution and legislation differently, he feels that the language in the Constitution is clear and that confirmation of appointments are to occur during the regular sessions,” according to the statement.

Entities met in Minerals chambers Jan. 5, details from meeting have yet to be released

The Osage Minerals Council, Chief John Red Eagle, Assistant Chief Scott BigHorse, Minerals Council liaison Everett Waller, Bureau of Indian Affairs Superintendent Melissa Currey and some oil producers all met in the OMC chambers Wednesday.

As to what the entities discussed at the meeting, took action on, or resolved is unknown. Minutes of the meeting have been requested, questions have been sent to the OMC, the Office of the Chiefs and BIA Superintendent Currey. Only the Office of the Chiefs has responded.

Council preps for Osage Oil & Gas Summit Oct. 27-29

The Osage Minerals Council is seeking an attorney.

At the OMC Oct. 8 meeting, Chairman Dudley Whitehorn told the attendees that only one attorney had come forth after asking his fellow council members to submit names for consideration. That attorney was Tulsa-based attorney William “Bill” Grimm, attorney for Jech vs. United States. The Jech case, if won, could abolish the Osage Constitution and which Whitehorn is also a plaintiff.

The Osage Minerals Council has selected three members to be the OMC’s representation on the Nation’s five-member Trust Team

The Osage Minerals Council has selected three members to be the OMC’s representation on the Nation’s five-member Trust Team. The trust team is made up of three OMC members, the principal chief and the speaker of the congress.

Dudley Whitehorn, Galen Crum and Cynthia Boone were unanimously voted in by the eight-member OMC July 21, and Whitehorn was voted to be the trust team chairman. They will join Principal Chief John Red Eagle and Speaker of the Congress Jerri Jean Branstetter.

PHS is second area high school to offer Osage language courses

The Pawhuska High School honored its students who completed the first Osage language class which started last fall.

Martin Parks, who is the school’s assistant principal and athletic director, presented a wooden plaque with the school’s orange and black colors to Osage Nation Language Department officials and language student Robynn Rulo on July 9. The names of 12 students who took the course were engraved into the plaque.
