Despite denial, Chief Red Eagle’s Office ‘confident’ three casino lands’ trust applications will be approved within a week

The United States Supreme Court will not hear the Osage Nation’s appeal in the reservation status case, which ends the 11-year-old legal battle with the Oklahoma Tax Commission on whether the Nation’s reservation was disestablished.

On Monday (June 27), the High Court filed a summary disposition of cases being considered. The case (Osage Nation v. Irby, et al.) is listed among those cases with petition denials, thus allowing the federal appeals court decision to stand. No explanation is listed for the Nation’s petition denial.

Case against the OK Tax Commission disputes whether the reservation was disestablished

Today the United States Supreme Court is scheduled to decide whether to hear the Osage Reservation status case against the Oklahoma Tax Commission.

The Supreme Court has set a conference date for today (June 23) to consider whether the nine justices will hear the Nation’s 11-year-old lawsuit against the Oklahoma Tax Commission.

Nation expects High Court to decide fate of case by end of June

The acting U.S. Solicitor General filed an amicus curiae brief May 27 to the U.S. Supreme Court advising the justices not to hear the Osage Nation’s reservation status case.

Congress will consider appropriation items for property purchase, litigation fees for reservation status case and changes to budget parameters act

Osage Nation Principal Chief John Red Eagle has issued an Executive Proclamation for a Special Session of the ON Congress, which starts at 10 a.m. on June 13.

This will be the seventh special session for the Second ON Congress, which will consider five items listed on the written proclamation issued by Chief Red Eagle’s office on May 24.

Osage reservation status case not over yet

The U.S. Supreme Court has called for the views of the Office of the Solicitor General in the Osage reservation status case against the Oklahoma Tax Commission before they decide whether or not to hear the case.

Chief’s office submits final land-into-trust application for three Osage casinos in jeopardy if case should be denied

The U.S. Supreme Court Justices will meet in conference Feb. 18 to decide whether or not to hear the Nation’s case against the Oklahoma Tax Commission. Their decision will be made public Feb. 22.

If the High Court grants certiorari, or the right to hear the case based on merits, the Nation will proceed in a round of briefs, opinions and oral arguments to win the case. If the High Court denies the case then the 11-year battle is over.

OK Tax Commission has until Jan. 11 to respond to the Nation's appeal

The Oklahoma state Tax Commission has received a 50-day extension on its deadline to respond to the Osage Nation's appeal in the long-standing case being challenged at the U.S. Supreme Court level. In another recent development, the National Congress of American Indians is siding with the Osages in this case and filed an amicus curiae brief during the Thanksgiving holiday week.

Congress votes down amending the Gaming Reform Act, passes $25,000 supplemental appropriation for OK Tax Commission lawsuit

The Second Osage Nation Congress ended its third Special Session on Nov. 12 by passing five bills and two resolutions. A bill seeking to modify the Nation’s Gaming Reform Act regarding litigation and legal matters was also voted down before Congress adjourned.

ONCA 11-02 (sponsored by Congressman Mark Simms) is “an act to provide for protections to the Osage Nation on legal matters of Osage gaming” which failed with seven “no” votes over five “yes” votes.

The Nation filed its appeal to the U.S. Supreme Court Oct. 22, the day Associate Justice Sonia Sotomayor set as the extended deadline for Chief Red Eagle’s new administration.

Governor Brad Henry sends letter to Department of Interior in support of Osage casinos

Principal Chief John Red Eagle confirmed Tuesday that the Nation will be appealing to the United States Supreme Court before Oct. 22 in it’s lawsuit against the Oklahoma state Tax Commission.
